SpecialistDoc Terms and Conditions

A) GENERAL

We have developed this service so as to allow you to access Specialist Medical Advice from our list of GMC registered Specialist Doctors.

All our doctors are actively practising Consultants and/or Specialists in their field and will be available to give you advice in their specialist field.

This service is accessed through our App “SpecialistDoc” or Website “Portal”(for doctors only) and is available as a video consultation.

We function solely as a Portal whereby Doctors on the Specialist Register of the General Medical Council (UK) can provide Specialist advice for your medical condition for a pre-determined fee. SpecialistDoc (the Portal) does not take any responsibility for the advice given by the specialist and when in doubt, you should seek a further opinion and clinical consultation as appropriate. The Specialist is wholly and fully responsible for any medical or management advice given during the consultation. You expressly accept and agree that our specialists are wholly and completely responsible for any medical advice given through our Portal. 

You understand and fully accept that use of the Portal is different from having a live consultation with a specialist in a clinic or hospital.

The Portal does not provide a Prescription service.

The Portal does not provide Medical Certificates or Fit notes.

Our services are fully compliant with existing Data Protection Guidance and GDPR regulations. It is understood that in order to provide this service, we will require some personal and clinical information about yourself in order to proceed with the consultation.

We are a UK based organisation and use existing UK legislation for the provision of our services. We are not able to take any clinical or legal responsibility for any advice given if it is used outside the United Kingdom.

“SpecialistDoc” is a subsidiary of Dr Khalil Razvi Ltd whose registered address is 86-90 Paul Street, London EC2A 4NE.

B) SITUATIONS THAT REQUIRE A CONSULTATION WITH A SPECIALIST IN THE CLINIC

The service is provided on the basis of your symptoms and relevant history during the consultation. It does not cover a full specialist consultation as you will not be examined physically.

We recommend that you seek a clinical consultation with a specialist in person in the following situations:

  • If you feel that the medical advice given during the consultation differs with previously given advice
  • if you have any uncertainty about the advice
  • if you feel that during the consultation, not all the relevant points were covered adequately
  • if our online specialist had recommended that you seek further specialist consultation in a physical clinic.

Not all conditions or symptoms are suitable for an online consultation. If during the online consultation, the specialist feels that you would need a more detailed medical examination, s(he) will advise accordingly.

We are not available to provide service in event of a medical emergency and notwithstanding any prior advice or opinion solicited through our service, if there is a change or deterioration in your condition, you should seek appropriate medical help.

We do not store any video or audio of the consultation either physically or electronically. The advice given by our specialist will be sent to you by electronic mail to summarise the consultation and recommendations made. You agree not to make any recording (audio/video or digital) of your consultation.

It is good practice and strongly advised that the information and recommendation of management given by our Specialist online is shared with your General Practitioner / Consultant.

 

C) TECHNICAL REQUIREMENTS TO USE THE PORTAL

Operating System and Browsers:Chrome 48 or newer, Mozilla Firefox 45.0 or newer

Android: Android Lollipop or newer

Apple iOS: iOS 11 and later

Internet Connection: Minimum 1Mbps or higher is recommended

Use of our Portal requires a good and stable internet connection with a speed of at least 1Mb/s.

You are strongly advised to avoid using public Wi-Fi as the speed and connectivity may be variable. Your information may not be secure if using such connections. We do not accept any responsibility for internet connectivity problems which have arisen from the user / client’s connections.

D) HOW IT WORKS & COSTS

Once you have registered with the service, you will be able to book an appointment with any of our available specialists on our App.

To make an appointment, you will need to select the specialty and the specialist from that specialty. You will then be required to choose a booking time slot (each slot is 15 minutes long). You can book a double time slot if needed.

The consultation will last for 12 minutes exactly and the specialist will have 3 minutes to type a summary of the consultation and recommendation to be emailed back to you.

On occasion, the session time may not be guaranteed to start at the exact time due to clinical and other reasons. If there was a significant delay, we will endeavour to contact you if this is possible and give you a rescheduled time.

Payment for each slot of 15 minutes cost £88/- (inclusive) and must be paid in advance.

You will receive an email and text confirmation of your appointment including a reminder text.

You are advised to enter the Virtual Clinic within 3 minutes of your consultation. The consultation starts when the specialist logs you in and a timer will be on display. The consultation ends when the timer shows that 12 minutes have elapsed.

E) CANCELLATION AND DEFERMENT OF APPOINTMENT

Our cancellation policy will apply if you were not able to make the appointment.

If you are late in logging into your appointment, you will only be able to utilise the unused time of the consultation and any lapsed time will not be refunded or replaced.

You have the ability to change your appointment before 24 hours of the appointment time.

You are entitled to a full refund if you cancel your appointment at least 24 hours before the appointment time.

You are entitled to 50% refund if you cancel between 12 and 24 hours before your appointment.

There is no refund for cancellations less than 12 hours. This also applies to bookings made within 24 hours.

You are however, able to reschedule up to 24 hours before the original appointment without additional costs.

F) INFORMATION YOU PROVIDE AND HOW WE USE IT

In order to provide this service, we will require the following personal information when you sign up for the service.

  • Your name and date of birth
  • Your address
  • Your email details
  • Your payment details e.g.credit or debit card

The App allows you to scan and upload your documents e.g. GP referral letter, Blood results, Scan/X-ray results etc. You give explicit and full permission for any private medical information to be accessed by the specialist you will be consulting.

The specialist report at the end of the consultation will be emailed to you which will be a clinical record for your use and it is advisable to share this with your GP.

The Portal stores the following information as follows:

  • Your personal information which was registered on the Portal. This will be stored as long as you maintain your account with us.
  • If you decide to leave the Portal, we will store your personal information for up to 30 calendar days before it is removed from the Portal.
  • The Portal does not store video consultation. Only the Clinical information that was uploaded for the consultation or the Specialist report at the end of the consultation will be stored as long as the account is active.

 

G) YOUR SPECIALISTDOC ACCOUNT

In order to access the Portal you represent and warrant that you are at least eighteen (18) years of age and possess the legal right, capacity and ability, on your own behalf to accept and agree to these Terms and Conditions.

The information you provide on registration with the Portal should be accurate and correspond to your personal data that you use with the NHS. You exercise sole responsibility in maintaining accurate account details and the running of your account. The account should not be used by anybody except yourself. If you have any concerns about the security of your account, you will notify us immediately of this concern. If notification is not received, it will be assumed that all account activity to be authorised by you.

If we have reason to believe that our Terms and Conditions and Portal is being misused or that there are security concerns, we exercise the sole right to suspend or deny access to our Portal as appropriate. SpecialistDoc also exercises its right and sole discretion to deny access to our Portal to registered and unregistered users.

Our Terms and Conditions will be updated from time to time and this update will be notified on logging in to the website.

H) LIMITATIONS & LIABILITIES

In any situation that arises whereby we are unable to deliver the services to you, we will endeavour to rectify it and notify you as soon as possible. You will be able to re-schedule a new appointment in these circumstances. You will have the right to cancel the appointment and get a full refund if the delay exceeds 72 hours.

In any instance where we are unable to fulfil the service to you, our total liability shall not exceed the amounts paid by you for the consultation. We are not responsible for any losses or damage incurred whatsoever from breaking these terms and conditions; we are not responsible for indirect, consequential or any other losses or damages due to any failure in the service.

We are not responsible or liable for any medical advice and opinion given by the Specialists who are registered on our Portal. The Specialists work as independent contractors on our Portal. Any dispute about clinical advice or opinion will have to be notified directly to the Specialist with whom you had the consultation.

By using our services and Portal, you agree not to:

  • Tamper, hack or modify any content in the Portal
  • Disrupt the proper working of the Portal and its security
  • Attempt to misuse any information arising from use of the Portal
  • Attempt to obtain and/or use data from the Portal which does not belong to you for any other purposes
  • Conduct any activity which is unlawful or illegal.

 

I) INTELLECTUAL PROPERTY AND LICENCES

The intellectual property of the Portal and all logos are the Property of SpecialistDoc and cannot be used without our explicit permission.

Whilst using our Portal, we grant you a temporary licence to access the Portal which is non-exclusive and non-transferable. You agree to use the Portal for your personal use only and agree not to distribute or sell or utilise any information derived from the Portal for commercial use or exploitation.

You are not permitted to make a recording of your consultation as this would contravene the Data Protection laws and our Terms and Conditions.

You will agree to comply wholly with the Computer Misuse Act 1990.

You may provide a link to our website or Portal for fair use without causing any damage or harm to our Portal.

J) ACCOUNT TERMINATION

You can terminate an account at any time. Under the Terms & Conditions stated in E), any amounts that is owing will be reimbursed within 7 working days provided there has been no breach of the Terms & Conditions.

We reserve the right to terminate your account if there has been a breach of the Terms & Conditions or for failure to provide us with any information requested for use on our Portal.

Upon termination of the account, we reserve the right to delete all data and files in relation to your account unless there was a statutory requirement for us to hold any data. Such data will be deleted within 30 calendar days of the termination.

K) DISPUTES

L) LEGAL

The Terms and Conditions are governed by English Law. If any part of these Terms and Conditions were deemed invalid or illegal in court, the other portions of the Terms and Conditions will continue to be in force.
